About these terms
These terms apply to everyone who uses the EVO app or the website evosport.tech. By creating an EVO account you agree to them, and to our privacy policy. If you have a question, email support@evosport.tech.
Who can use EVO
- Coach, organisation and parent accounts are for adults aged 18 or over. Whoever signs up for an organisation, such as a school or club, must be allowed to act for it.
- Athletes aged 14 or over can create their own account. If you are under 18, make sure a parent or guardian is happy for you to use EVO.
- Children aged 13 or under can’t create their own account. A parent or guardian must register them, or a coach must register them with a parent or guardian’s agreement. The child can then have their own login only with an invite code from that adult.
Giving true information
You must give true, accurate details when you use EVO, including your age and date of birth and the details of any athlete you add. Giving a false date of birth to get around the age rules breaks these terms.
If we learn or reasonably believe that an account belongs to a child aged 13 or under without a parent or guardian’s agreement, we may suspend or close it and delete the child’s data, without notice. We may ask for information to confirm someone’s age or that a parent or guardian has agreed.
Coaches and organisations
If you add athletes to EVO, including by importing a list, you are responsible for having the right to do so. In particular, you agree that:
- before you add a child aged 13 or under, or create an invite code for them, you have the agreement of their parent or guardian, and the parent or guardian details you enter are correct (an organisation that doesn’t enter a parent’s name must keep a record of that agreement itself and show it to us if asked);
- you tell athletes, and parents of athletes under 18, what you record about them in EVO and why;
- you keep athletes’ details accurate, and correct or delete them when an athlete or parent asks, or when you no longer need them;
- you only share reports and share links with people who should see them;
- you follow your club’s or governing body’s safeguarding rules when using EVO.
When you tick a box to confirm a parent or guardian has agreed, you are telling us that is true. We rely on it and keep a record of it.
Parents and guardians
If you create a Parent account, you confirm you are the parent or legal guardian of each child you add, and that you agree to EVO holding their details and results. You can delete a child’s details, or your whole account, at any time.
Your responsibility for information you give
Coach and organisation accounts agree to cover our reasonable losses and costs if someone makes a claim against us because you added a person’s details without the permission needed (including a parent or guardian’s agreement for a child), gave false information, or broke these terms.
Every user is responsible for the information they give. We are not responsible for loss caused by someone giving us false details, including a false age.
Fitness testing and safety
Fitness tests such as sprints, jumps and bleep tests are physical activities. EVO times and records them but does not supervise them. Coaches, and parents when testing their own children, are responsible for warming up, a safe surface and space, and making sure athletes are fit to take part. Camera times and measurements are estimates and can be affected by light, phone position and other things. EVO does not give medical advice.
Plans and payments
EVO is free to download. Paid plans are bought in the app through the Apple App Store or Google Play, under their terms. You must be 18 or over to buy a plan. Under 18s have their own athlete plan, approved and paid for by a parent or guardian. Children aged 13 or under can’t buy a plan; athletes aged 14 to 17 need a parent or guardian to approve and pay for theirs. If a payment fails and isn’t fixed, or a subscription ends, the account moves to the Free plan; nothing is deleted. Club coach logins are limited by the club’s plan. To cancel, use your App Store or Google Play subscription settings. Deleting your EVO account does not cancel a subscription. Coaching memberships and testing days that your club sells you are between you and your club.
Using EVO fairly
Don’t misuse EVO. That includes trying to reach other people’s data, adding people’s details without permission, uploading anything unlawful or harmful, or interfering with how EVO works. We may suspend or close accounts that break these terms.
Our responsibility to you
We work hard to keep EVO running and your data safe, but we can’t promise it will always be available or free of errors. Nothing in these terms limits our responsibility for death or personal injury caused by our negligence, for fraud, or anything else the law doesn’t allow us to limit. If you use EVO as a consumer, you also have legal rights these terms don’t affect.
Otherwise, we are not responsible for loss we couldn’t reasonably have expected, or for loss of business or profit. For coach and organisation accounts, our total responsibility is limited to the amount you paid us for EVO in the 12 months before the claim.
Closing your account
You can delete your account at any time in the app (More, then Settings, then Delete account) or by emailing us. We may close accounts that break these terms, and will tell you why unless the law or a child’s safety means we can’t.
Changes and the law
We may update these terms as EVO changes, and will show the date of the latest version here and tell you in the app about important changes. These terms are governed by the law of England and Wales. If you live in Scotland or Northern Ireland, you can also bring a claim in your local courts.
